Terms and Conditions

If you wish to proceed with a bespoke consultation, I will ensure you are sent the information below. Please be sure to read thoroughly and let me know if you have any further questions.​

1. Acceptance of Terms

 

By placing an order with Deana Baker, you agree to be bound by these Terms and Conditions.

 

2. Services

 

Bespoke Jewellery: I specialise in creating unique, bespoke jewellery pieces using your sentimental gold and gemstones. This may include additional new materials, depending on the design. 

3. Client Obligations

 

Item Submission: You are responsible for securely packaging and shipping your sentimental items to me.

 

Item Description: Please provide a detailed description of your items, including any specific requests or preferences.

 

Ownership: You must confirm that you are the rightful owner of the items submitted.

 

4. Design Process

 

Initial Consultation: We will discuss your ideas and preferences during an initial consultation.

 

Design Proposal: I will provide a design proposal, including sketches or renderings, for your approval.

 

Modifications: You may request alterations to the design, but please note that significant changes may affect the timeline and cost.

 

5. Fees and Payments

Deposit: A non-refundable deposit is required to initiate the making process.

Payment Schedule: The remaining balance is due upon completion of the piece.


Payment Methods: I accept bank transfers, PayPal, and card payments. 

 

6. Timeline

 

Estimated Completion Time: I will provide an estimated completion time based on the complexity of the design and my current workload.

 

Delays: I cannot guarantee specific timelines and may experience delays due to unforeseen circumstances.

 

7. Return Policy

 

Bespoke Commissions: Due to the bespoke nature of my services, I cannot offer refunds or exchanges on bespoke pieces.​

Reworked Items: If you are not satisfied with the reworked item, I may be able to make minor adjustments at no additional cost.

8. Definition of Goods Held in Trust

"Goods Held in Trust" refers to any gold, gemstones, or other materials provided by the Client to Deana Baker for the purpose of creating a bespoke jewellery piece.

9. Client Ownership
 

The Client retains ownership of the Goods Held in Trust at all times.
Deana Baker acts as a custodian of these goods, holding them securely until the final piece is delivered to the Client.


10. Insurance
 

Deana Baker will maintain adequate insurance coverage for Goods Held in Trust while they are in our possession.


The Client is encouraged to maintain their own insurance coverage for the Goods Held in Trust.


11. Security Measures
 

Deana Baker will implement reasonable security measures to protect Goods Held in Trust, including:

 

  • Secure storage facilities

  • Inventory control systems

  • Limited access to the workspace

12. Gemstone Removal and Resetting

Disclaimer of Liability for Accidental Damage
 

While we take every precaution to minimise the risk of damage during the removal and resetting of gemstones, we cannot guarantee that accidental damage will not occur. Gemstones, particularly those with intricate settings or delicate structures, are susceptible to damage during the removal process.

13. Client's Responsibility
 

The Client acknowledges and agrees that:

Gemstones are fragile and may be damaged during the removal and resetting process, even with the utmost care.
The Client is responsible for insuring their gemstones prior to submitting them for removal or resetting.


14. Best Efforts
 

Deana Baker will use reasonable care and skill to minimise the risk of damage during the removal and resetting process.

This includes:
 

  • Using specialised tools and techniques.

  • Employing experienced jewellers.

  • Regularly maintaining and calibrating equipment.

15. Limitation of Liability
 

Deana Baker shall not be liable for any loss or damage to gemstones that occur as a result of:
 

  • The inherent fragility of gemstones.

  • The complexity of the setting.

  • Unforeseen circumstances or accidents.​

16. Client's Right to Refuse Service

The Client has the right to refuse the removal or resetting of gemstones if they believe the risk of damage is too high.

17. Communication and Transparency

Deana Baker will communicate with the Client throughout the process, providing updates on the status of the work and any potential risks.


18. Return of Goods
 

Upon completion of the bespoke jewellery piece, any remaining Goods that haven't been reworked and Held in Trust will be returned to the Client.


If the Client cancels the project, Deana Baker will return the Goods Held in Trust, subject to any agreed-upon fees or charges.

19. Intellectual Property

 

Design Rights: All designs created by Deana Baker remain my intellectual property.

Client Rights: You retain ownership of the materials provided and the completed jewellery piece.​​

20. Inevitable Material Loss

The Client acknowledges and agrees that the reworking of gold and silver items may result in the inevitable loss of material. This loss can occur during various stages of the reworking process, including:

  • Sawing and Cutting: Removing sections of metal to create new designs.

  • Soldering: Joining pieces of metal, which may involve melting and reflowing.

  • Polishing and Finishing: Removing excess metal to achieve a smooth, polished surface.
